AGREEMENT TO TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and When You Can't Cope, There's Hope ("WYCCT," "we," "us," or "our") concerning your access to and use of the www.whenyoucantcope.org website and any related services, applications, or content (collectively, the "Site").

2.2 Trademarks

"When You Can't Cope, There's Hope," "WYCCT," and all related logos will be trademarks or registered trademarks of WYCCT. You may not use these marks without our prior written consent.

2.3 Limited Use Permission

You may

You may NOT

  • You will receive a receipt via email for tax purposes

  • We do not store full credit card information on our servers

4.3 Recurring Donations

If you set up recurring donations:

  • You authorize us to charge your payment method on the designated schedule

  • You may cancel at any time by contacting us at Intake@whenyoucantcope.org

  • Cancellation takes effect for the next scheduled donation

4.4 Refund Policy

Donations are generally non-refundable. However, if you believe an error occurred (e.g., duplicate charge, incorrect amount), contact us within 30 days at Intake@whenyoucantcope.org, and we will review your request.

4.5 Use of Funds

Donations are used to support WYCCT's mission and programs. While you may designate gifts for specific purposes, WYCCT retains ultimate discretion over fund allocation to ensure effective use of resources.

5. APPLICATIONS FOR SERVICES
5.1 Application Process

When you apply for housing or services:

  • You must provide accurate, truthful information

  • Providing false information may result in denial or termination of services

  • Submission of an application does not guarantee acceptance

  • We will review applications and notify you of our decision

Application information is confidential and protected under our Privacy Policy and applicable laws (including HIPAA).

IN NO EVENT SHALL WYCCT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO WYCCT IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8.3 Jurisdictional Limitations

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless WYCCT and its directors, officers, employees, volunteers, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms

  • Your violation of any law or regulation

13.3 Effect of Termination

Upon termination:

14. GOVERNING LAW & DISPUTE RESOLUTION
14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.

14.2 Jurisdiction & Venue

You agree that any legal action or proceeding arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Richland County, South Carolina.

You consent to the personal jurisdiction of these courts and waive any objection to venue.

14.3 Dispute Resolution Process

Before filing a lawsuit, you agree to first contact us to attempt to resolve the dispute informally:

  2. We will attempt to resolve the dispute through good-faith negotiation

  3. If we cannot resolve the dispute within 30 days, either party may pursue legal remedies

14.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.5 Limitation on Time to File Claims

ANY CLAIM ARISING FROM THESE TERMS OR USE OF THE SITE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE. After one year, the claim is permanently barred.

15. SEVERABILITY & WAIVER
15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.2 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WYCCT regarding use of the Site and supersede all prior agreements and understandings.

17. ACCESSIBILITY

WYCCT is committed to ensuring our Site is accessible to individuals with disabilities. We strive to comply with Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.
